A d\u00e9faut de correction sous 3 ans,\u00a0 les employeurs s&rsquo;exposeront \u00e0 une p\u00e9nalit\u00e9 financi\u00e8re susceptible d&rsquo;atteindre\u00a01 % de la masse salariale .<\/p>\n\n\n\n<p>Art. L. 1142-8. \u2013 <em>Dans les entreprises d\u2019au moins cinquante salari\u00e9s, l\u2019employeur publie chaque ann\u00e9e des indicateurs relatifs aux <strong>\u00e9carts de r\u00e9mun\u00e9ration<\/strong> entre les femmes et les hommes et aux actions mises en \u0153uvre pour les supprimer, selon des modalit\u00e9s et une m\u00e9thodologie d\u00e9finies par d\u00e9cret.<\/em><\/p>\n\n\n\n<p>\u00ab Art. L. 1142-9. \u2013 <em>Dans les entreprises d\u2019au moins cinquante salari\u00e9s, lorsque les r\u00e9sultats obtenus par l\u2019entreprise au regard des indicateurs mentionn\u00e9s \u00e0 l\u2019article L. 1142-8 se situent en-de\u00e7\u00e0 d\u2019un niveau d\u00e9fini par d\u00e9cret, la n\u00e9gociation sur l\u2019\u00e9galit\u00e9 professionnelle pr\u00e9vue au 2\u00b0 de l\u2019article L. 2242-1 porte \u00e9galement sur les mesures ad\u00e9quates et pertinentes de correction et, le cas \u00e9ch\u00e9ant, sur la programmation, annuelle ou pluriannuelle, de mesures financi\u00e8res de <strong>rattrapage salarial<\/strong>. En l\u2019absence d\u2019accord pr\u00e9voyant de telles mesures, celles-ci sont d\u00e9termin\u00e9es par d\u00e9cision de l\u2019employeur, apr\u00e8s consultation du comit\u00e9 social et \u00e9conomique. La d\u00e9cision est d\u00e9pos\u00e9e aupr\u00e8s de l\u2019autorit\u00e9 administrative dans les m\u00eames conditions que le plan d\u2019action mentionn\u00e9 \u00e0 l\u2019article L. 2242-3. L\u2019autorit\u00e9 administrative peut pr\u00e9senter des observations sur les mesures pr\u00e9vues par l\u2019accord ou la d\u00e9cision de l\u2019employeur.<\/em><\/p>\n\n\n\n<p>Bref, notons que les textes \u00e9voquent les notions d&rsquo; \u00ab\u00a0\u00e9carts de r\u00e9mun\u00e9ration\u00a0\u00bb et de \u00ab\u00a0rattrapage salarial\u00a0\u00bb sans plus de pr\u00e9cisions : gageons qu&rsquo;il faut comprendre que la correction se fera \u00e0 la hausse pour les femmes m\u00e9ritantes et non \u00e0 la baisse pour les salaires des hommes peu performants.
